In these terms and conditions:
- “GoMijas.com” refers to the rental organization.
- “Owner” refers to the rightful owners of the accommodation.
- “Accommodation” refers to the vacation apartment.
- “Guest(s)” refers to the person (or persons) named in the booking confirmation and guest list, or the person (or persons) staying in the accommodation.
Acceptance of the terms: The guest(s) named in the booking confirmation guarantee(s) that he, she, or they are authorized to agree to these general terms and conditions, acting on behalf of all guests, including any guests that may be added to the party at a later date. The guest(s) named in the booking confirmation will ensure that all guests staying in the accommodation comply with the terms, house rules, and/or rules applicable within the complex/vacation resort. The accommodation is solely intended for holiday accommodation, and all guests will therefore vacate the accommodation at the end of the agreed rental period. By making the deposit, it is confirmed that these general terms and conditions are accepted, and the accuracy of the details and information stated on the booking confirmation is confirmed.
Booking: Upon receiving the booking confirmation, you have 24 hours to make the deposit. The accommodation will be reserved for you during this period.
Payments: The deposit of 20% must be paid within 24 hours of receiving the reservation confirmation. The booking will be confirmed for you once the initial deposit is received. The remaining amount must be paid no later than 6 weeks before arrival.
Guest list: Along with the booking confirmation, you will receive a guest list. This guest list must include the name(s), age(s), and passport number(s) of the guest(s) staying in the accommodation. The guest list must be fully completed and sent by email to info@gomijas.com without delay.
Occupancy: The occupancy of the accommodation is limited to four people as indicated in the property description or specified on the booking form unless otherwise agreed in writing. The guest(s) will not sublet or share the accommodation with guests other than those described on the guest list. Any additional occupancy must be notified and approved by GoMijas.com in writing before arrival. GoMijas.com reserves the right to use all legal means to remove persons staying in the accommodation without authorization or knowledge from GoMijas.com. The guest(s) agree to treat the accommodation with the utmost care.
Self-catering: The accommodation is based on self-catering. No meals are provided or included in the price, but your accommodation is equipped with a fully equipped kitchen for preparing your own meals. Usually, some basic products such as coffee, tea, sugar, creamer, and a bottle of drinking water are provided.
Cleaning service, bed linen & towels: The accommodation is cleaned, and clean bed linen and towels are provided shortly before the arrival of new guests. For each guest, 1 set of bed linen, 2 large towels, 2 small towels, and 2 washcloths are provided per week. There is a washing machine in the accommodation that can be used unlimitedly for washing bed linen, towels, and clothing. Please note that the provided bath towels and bed linen are for use in the accommodation only and may not be taken from the accommodation for use elsewhere. Hammam towels are available for use outside the accommodation (terrace/garden/pool). Cleaning service during your stay is not included. Upon departure, the guest(s) will leave the accommodation in a swept-clean and tidy condition, and household waste must be deposited in the designated containers outside the accommodation, and all used items will be returned to their original place. Although a paid final cleaning is a mandatory part of the rental by GoMijas.com, it reserves the right to charge additional costs if the guest(s) leave the accommodation in an unacceptable condition.
Cleaning during your stay: Extra cleaning service during your stay is possible by arrangement.
Passport details and police check-in: Every person over 16 years of age renting holiday accommodation in Spain or staying in a hotel is registered with the police with their passport details. This is a legal requirement for landlords of holiday accommodations and hotels.
Secured passport scan app: GoMijas.com has (not yet) a secure passport scan app that is directly linked to the relevant police stations. Your passport details are scanned, after which you enter your signature digitally. The passport details are encrypted and sent to and stored on secure servers. All of this is done in accordance with the General Data Protection Regulation (GDPR) of May 25, 2018. See also: GDPR Privacy Statement
Check-in: Check-in and key handover at the accommodation are possible from Monday to Saturday between 16:00 and 18:00 local time. Earlier or later check-in is possible only by arrangement and with written confirmation by email or WhatsApp from GoMijas.com. (See information below). On Sundays, Christmas Day, Boxing Day, New Year’s Day, January 12, and during Easter, guided check-ins are not possible. On these days, the keys can be collected from the key safes. (See information below).
Collecting keys from key safes: If you wish to check-in outside office hours, you must notify this by email at least 1 week before arrival to info@gomijas.com. Upon arrival outside office hours, the keys can be collected from one of the key safes of GoMijas.com. Well before arrival, you will receive the full address of the key safes with all check-in and check-out instructions, and the address with directions to the accommodation.
Additional costs for late check-in: Arrival outside office hours may incur additional costs if the keys cannot be collected from one of the key safes for any reason. The costs for a guided late check-in from Monday to Saturday are 50 euros. Please note: guided check-in outside office hours is only possible after prior consultation but may be impossible at certain times. On Sundays, Christmas Day, Boxing Day, December 28, New Year’s Day, and during Easter, we do not offer guided check-ins.
Check-out: Before 10:00 am local time. Late check-out is only possible after prior consultation and written confirmation from GoMijas.com. The keys must be returned at the final inspection or, at the instruction of GoMijas.com, hung back in the key safe outside. The full address and location of the key safe will be sent to you after making your reservation.
Accommodation arrival check: After check-in, guests have a period of 24 hours to report any defects or damages to GoMijas.com. At the end of this 24-hour period, the rented items will be considered free of damage upon the arrival of the guest(s).
Final inspection and any damages: An employee of GoMijas.com will inspect the accommodation and inventory after your departure. Waste must be removed from the accommodation upon departure and deposited in the designated garbage containers outside the accommodation, which you will find along the public road. Upon departure, the accommodation and the contents must be in the same condition as upon arrival. Guests agree to take good care of the accommodation and leave all inventory and equipment in a clean and tidy condition at the end of the holiday. Guests agree to pay for any breakage, loss, or damage to the accommodation and inventory caused by the guests.
Keys: Two sets of keys (plus one remote control for the garage and entrance gate, if applicable) will be provided to the guest(s) for the duration of their stay. Should the guest(s) lock themselves out of the accommodation and require assistance from a GoMijas.com staff member to regain entry, a fee starting from €30 will be charged, depending on the time and location of the accommodation.
Loss of Keys In the event of loss or misplacement of one or more keys, a fee starting from €150 will be charged to cover the costs of replacing the lock(s).
Locked Out If you find yourself locked out without the key, please contact GoMijas.com immediately. During office hours, we can come and unlock the door with a spare key. The cost for this service starts at €30, depending on the location. Outside office hours, or if you have left the key inside the door, a locksmith will need to open the door for you. The cost of the locksmith must be paid by you directly to the locksmith.
Cancellation Policy
- For cancellations up to 60 days before arrival, the cancellation fee is 20% of the travel sum.
- For cancellations between 59 days and 31 days before arrival, the cancellation fee is 50% of the travel sum.
- For cancellations from 30 days before arrival, the full travel sum will be charged.
A cancellation must be communicated in writing or by email to GoMijas.com by the person who made the booking.
Travel and Cancellation Insurance We strongly recommend that you take out good travel and cancellation insurance to cover damage to or loss of personal belongings, legal liability, cancellation costs, etc. These costs are not covered by GoMijas.com or the insurance of GoMijas.com or the owner.
Rules for Pool(s) and Other Facilities For safety reasons, it is not allowed to use or bring glass, bottles, or other breakable glassware or crockery in and around the pool area. The use of facilities at or near the accommodation, such as a swimming pool, gym, etc., is entirely at the user’s risk. GoMijas.com or the property owner cannot be held liable for any injury to a guest(s) or loss or damage to personal belongings of the guest(s). All guests and users must respect the rules displayed in the house rules and/or on a board at the pool, in the gym, etc.
Children at the Pool For safety reasons, it is prohibited for children to use the communal or private pools without supervision from an adult.
WiFi Internet The internet connection on the Costa del Sol may not always be as fast and stable as in your home country. Our accommodations are equipped with a fixed internet connection with Wi-Fi, but if a reliable internet connection is crucial for you during your vacation (e.g., for your work), it might be wise to create a hotspot with your 5G mobile phone.
Private Areas of the Owner Any room or closet space in the accommodation that is locked and for which no key is provided to the guest(s) is private and not intended for use by the guest(s). The same applies to the mailbox; it is not for use by tenants, and there is no key for it.
Pets Pets are NOT allowed in our accommodations, nor in and around the complex/grounds of your vacation apartment. Non-compliance may lead to additional costs charged to the guest(s) or the removal of the pet(s) from the accommodation and placing the pet(s) in a kennel at the guest(s)’ expense.
Repairs & Maintenance While every effort is made to respect the peace and privacy of the guest(s), GoMijas.com or one of its employees reserves the right to enter the accommodation, after consultation with the guest(s) and at reasonable times, to perform necessary work such as maintenance or repair of equipment or machines in and around the accommodation, garden maintenance, pool cleaning and maintenance, and to carry out any necessary repairs to the accommodation.
Construction Activities The accommodations that are rented are private properties of individual owners. The accommodations are not located in holiday parks, but are private apartments in residential areas or in a more or less rural environment. This may result in unexpected construction work taking place in the vicinity of the accommodation you have rented. These works may be carried out by other homeowners, contractors, and/or government institutions, with which we have no relationship and over which we have no influence. Both the accommodation provider, booking agent, landlord, or owner are therefore excluded from any liability for the inconvenience caused by construction work not commissioned by the accommodation provider itself.
Responsibility of the Guest(s) The guest(s) shall immediately notify GoMijas.com of any defects in the accommodation, malfunctions of equipment, installations, household appliances, or the pool so that measures can be taken as soon as possible for repair or replacement. The guest(s) agree to compensate GoMijas.com for damage due to breakage, loss, or damage to goods, utensils, or other items belonging to the accommodation caused by the guest(s).
It is NOT allowed to charge electric vehicles at the property.
Cancellation by GoMijas.com Should GoMijas.com have to cancel your booking because the accommodation is unavailable for any reason, GoMijas.com offers the guest(s) the following options:
- An equivalent accommodation (if available)
- Refund of all payments received by GoMijas.com The guest(s) shall not hold GoMijas.com or the owner of the accommodation liable for any damage or loss due to the unavailability of the accommodation other than the refund of payments made to GoMijas.com if no alternative accommodation is available. Should GoMijas.com have to cancel your booking during your stay in the accommodation because the accommodation is no longer available due to any unforeseen circumstance, then GoMijas.com offers the guest(s) the following options:
- An equivalent accommodation (if available) for the remaining time of the agreed rental period
- Refund of a portion of the payments received by GoMijas.com. (The refund is calculated based on the number of days the vacation is ended early in relation to the total number of vacation days) The guest(s) must be aware that an alternative accommodation (if available) may result in an additional payment if the alternative accommodation is more expensive than the original accommodation. Moreover, the guest(s) must accept that the alternative accommodation may differ from the original accommodation and that it may not have the same amenities or location as the original.
Limitation of Liability GoMijas.com, its employees, or the owner shall not be held liable by the guest(s) and co-residents for: a) Loss of holiday enjoyment or extra costs resulting from any delay or changes to flights, travel arrangements, or other services beyond the control of GoMijas.com.
b) Any loss, damage, or inconvenience resulting from adverse weather conditions, strikes, riots, not being able to use the pool due to drought measures or maintenance, or other matters beyond the control of GoMijas.com or the owner.
c) Any temporary defect or interruption of heating, air conditioning, internet connection, electricity, water, gas, or other public utilities, as well as government restrictions due to drought measures.
d) Any damage due to cancellation by the guest(s) other than described in the cancellation costs.
e) Any damage or compensation, other than the refunding of payments already made, due to the inability to provide the accommodation as described at; alternative accommodation.
f) No responsibility can be taken for any loss of or damage to any motorized vehicle and/or its contents which are located on the property of the accommodation. Although GoMijas.com and/or the owner will make every effort to remedy any defects in the accommodation, household appliances, or other equipment as quickly as possible, the guest(s) acknowledge that due to the limited rental period, a repair or replacement may not be possible in a timely manner. In such a case, GoMijas.com or the owner shall not be held liable for any inconvenience suffered. GoMijas.com has made the utmost effort to ensure that the data and details of the accommodation on the websites or other promotional materials are truthfully displayed. Despite the careful composition of the information, no liability can be accepted for any errors in the text. GoMijas.com therefore accepts no liability for the consequences of incompleteness or incorrectness in the texts. GoMijas.com reserves the right at all times to change, supplement, or remove the content of the websites on which its accommodations are advertised for any reason without having to notify anyone.
